1. Parties and scope
These terms govern the use of the Ortamix service (the ortamix.com website, the management panel and the Ortamix app) provided by Disparco Bilişim Medya ve Teknoloji Ticaret Limited Şirketi ("Disparco"). Businesses and users who use the service are deemed to accept these terms and the data processing described in the Privacy Policy. If a separate written contract has been made with the business, that contract takes precedence.
2. The service
Ortamix is a subscription service that provides the tracks in the Ortamix catalogue for businesses to play as background music in their own premises. With a subscription the business gets the right to use the panel and the app, to play the Ortamix catalogue at its branches, to play announcements and to receive a license certificate for each branch. What each plan includes is shown on the pricing page.
The subscription is per branch. One device plays at each branch at a time; the other devices are used as remotes.
3. Use of the music
- Catalogue tracks may only be played as background music at the subscribing business's branch, through the Ortamix app.
- Tracks may not be recorded, copied, moved to another device or service, or used by a broadcaster (radio, television, internet broadcast), in advertising, in video or in another work; they may not be played for broadcast outside the business (for example over street-facing speakers at a public event).
- The cache on the device is encrypted and only the Ortamix app plays it; attempting to get around this is prohibited.
- Ortamix only plays its own catalogue. Music the business plays from outside Ortamix (radio, television, its own playlists) is not covered by this service or the license certificate; the business is responsible for any permissions needed for it.
4. License certificate
The license certificate issued for each branch shows that the branch has an Ortamix subscription for the period on the certificate and the right to play the Ortamix catalogue. The QR code on the certificate opens an Ortamix page showing whether the certificate is valid. When the subscription ends, the certificate shows as invalid. The certificate applies only to the Ortamix catalogue; it cannot be used for music played from other sources.
Disparco keeps a record of the rights holders and usage permission of every track in the catalogue; a track whose rights record becomes incomplete or disputed is withdrawn from the catalogue and is not played on devices.
5. Account and users
- Disparco opens the business account; a password setup link is emailed to the business owner.
- The business owner can add branch staff as a team; the business is responsible for staff accounts and their actions.
- Passwords must not be shared. If unauthorised use of an account is suspected, the password should be changed immediately and reported to [email protected].
- Account details should be kept accurate; the branch address and time zone are used so that the schedule runs at the right time.
6. Fees and price changes
Ortamix fees are per branch, per month, in Turkish lira (TRY), excluding VAT. The payment method and invoicing are agreed with the business when the subscription is opened. If fees change, the business is notified by email at least 30 days before the change takes effect. The new fee applies from the first period starting after this notice; the fee for a period already paid does not change for that period. A business that does not accept the new fee is free not to renew its subscription.
When a paid period ends and the subscription is not renewed, devices stop playing shortly afterwards and the license certificate shows as invalid.
7. Announcements
The business is responsible for the content of announcements it uploads or writes. Announcements may not contain music or audio belonging to others or unlawful content. Text-to-speech announcement texts are sent to Google's service to be voiced; personal data should not be written in announcement texts. Text-to-speech use is subject to the monthly character limit of the plan.
8. Intellectual property
The Ortamix name and logo, and the design, texts and software of the website, panel and app belong to Disparco. The rights to the works in the catalogue belong to their rights holders; the subscription grants the business no rights other than the use described in these terms.
9. Prohibited use
- Collecting data or files from the website, panel or app by automated means,
- Trying to bypass security measures or to access another business's account, branch or device,
- Putting a load on the service beyond normal use,
- Reverse engineering or modifying the app, or using a modified version,
- Transmitting malware or unlawful content.
In case of use against these terms, Disparco may close the account or device concerned.
10. Limitation of liability
Disparco takes the care needed for the service to work without interruption or error, but does not guarantee it; access may stop temporarily during maintenance and updates. During an internet outage the device keeps playing the tracks it downloaded in advance; keeping the device, the internet connection and the sound system working is the business's responsibility.
11. Changes
These terms may be updated; the current text applies from the date it is published on this page. Significant changes affecting subscribing businesses are also notified by email. The date of the last update is shown at the end of the page.
12. Governing law
These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Bingöl have jurisdiction over disputes; consumers' statutory rights of application are reserved.
